Our legal costs for dealing with the administration of an estate are ordinarily charged on an hourly basis but fixed fees can be agreed subject to you providing us with an accurate estimate of the estate and any complexities. The hourly rates are between £225 and £250 per hour plus VAT (at 20%). You would expect a small estate to take no less than two hours and for complex estates this may result in over 50 hours of solicitors’ time.
Disbursements include the application fee which is currently £155 inc VAT (at 20%). A notice may also be placed in the London Gazette (£99.90 inc VAT (at 20%)) to protect the Executors against claims from unknown creditors.
Included in our fees: registering the death with all the organisations, obtaining the date of death information necessary for completing the appropriate Inheritance Tax form, notifying the Beneficiaries of their entitlement, completing the Inheritance Tax Account or Inheritance Tax Return, preparing and submitting the grant application to the Probate Registry, encashing/transferring the assets of the Estate, settling the liabilities of the Estate, settling the income and Capital Gains Tax position of the Estate both to the date of death and covering the period from date of death to completion of the Estate; (in highly complex cases we would reserve the right to employ a specialist accountant to deal with this), preparing final Estate Accounts, distributing the Estate to the Beneficiaries and issuing tax certificates
Depending on the complexity of the Estate, we would anticipate completion of matters to take between 6 months and 18 months.
Services not included in the above costs include residential conveyancing work to sell a property and dealing with an estate where there is no will
